of Sale"},"content":{"rendered":"<h2>CONDITIONS OF SALE<\/h2>\n<p><strong>Larkrise Auctions carries on business with bidders, buyers and all those in connection with a sale on the following general conditions and on such other terms, conditions and notices as may be referred to herein.<\/strong><\/p>\n<p><strong>DEFINITIONS IN THESE CONDITIONS:<\/strong><\/p>\n<ul>\n<li><strong>\u2018\u2019Auctioneer\u2019\u2019 means the firm of Larkrise Auctions or the authorised auctioneer as appropriate.<\/strong><\/li>\n<li><strong>\u2018\u2019Hammer price\u2019\u2019 means the level of bidding reached at or above any reserve on an item when the auctioneer brings down the hammer.<\/strong><\/li>\n<li><strong>\u2018\u2019Terms of consignment\u2019\u2019 means the terms and rates of commission on which Larkrise Auctions accepts instructions from sellers or their agents.<\/strong><\/li>\n<li><strong>\u2018\u2019Total amounts due\u2019\u2019 means the hammer price in respect of the lot sold together with any premiums.<\/strong><\/li>\n<li><strong>\u2018\u2019Sale proceeds\u2019\u2019 means the amount due to the seller being the hammer price of the lot sold less commission at the stated rate.<\/strong><\/li>\n<\/ul>\n<p><strong>BIDDING PROCEEDURES AND THE BUYER:<\/strong><\/p>\n<ul>\n<li><strong>Bidders are required to register their particulars and to satisfy any security arrangements before bidding on any lot.<\/strong><\/li>\n<li><strong>The maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid shall be settled at the auctioneer\u2019s absolute discretion.<\/strong><\/li>\n<li><strong>Once made, no bid may be withdrawn.<\/strong><\/li>\n<li><strong>Our right to bid on behalf of the seller up to the amount of any reserve and the right to refuse any bid is at the discretion of the auctioneer.<\/strong><\/li>\n<\/ul>\n<p><strong>ONLINE LIVE BIDDING:<\/strong><\/p>\n<ul>\n<li><strong>In completing the bidding registration on and providing your debit card details, unless alternative arrangements are agreed, you authorise Larkrise Auctions if they so wish to charge to the debit card given the full amount payable for items successfully purchased in the auction.<\/strong><\/li>\n<li><strong>We do not guarantee that any live auction service will not be interrupted or error-free or that bids will be received or any information regarding current price will be transmitted in a timely fashion.<\/strong><\/li>\n<\/ul>\n<p><strong>INCREMENTS<\/strong><\/p>\n<ul>\n<li><strong>Bidding increments shall be at the auctioneer\u2019s discretion.<\/strong><\/li>\n<\/ul>\n<p><strong>THE PURCHASE PRICE<\/strong><\/p>\n<ul>\n<li><strong>The buyer shall pay the hammer price together with a premium.\u00a0 For all sales, the premium is 10% plus online fees<\/strong><\/li>\n<\/ul>\n<p><strong>DROIT de SUITE<\/strong><\/p>\n<ul>\n<li><strong>The sale of works of art by living artists or those who have died in the last seventy years that make over 1000 Euros will incur a royalty payment to the Design and Copyright Society.\u00a0 Please note, the royalty payment is calculated on the rate of exchange of the European Central Bank on the date of the sale.\u00a0 \u00a0The royalty will be charged to the buyer at the hammer price and in addition to the buyers\u2019 premium.<\/strong><\/li>\n<\/ul>\n<p><strong>PAYMENT<\/strong><\/p>\n<ul>\n<li><strong>Immediately a lot is sold, you will pay to us the total amount in cash or in such other way as agreed by us.\u00a0 We accept cash, bank transfer, or debit cards.<\/strong><\/li>\n<li><strong>All purchases must be paid for in full before release of lots.<\/strong><\/li>\n<li><strong>Payments over 500 pounds must be made by bank transfer.\u00a0 Bank transfer charges are the responsibility of the purchaser.<\/strong><\/li>\n<li><strong>Purchases will not be released from the saleroom until we are in receipt of cleared funds.\u00a0 When the purchaser is collecting from the saleroom, the original card used for payment will need to be produced.<\/strong><\/li>\n<li><strong>If a third party is collecting on behalf of the purchaser, we will require prior written authority and also a copy of the invoice and the identification of the third party collecting.<\/strong><\/li>\n<\/ul>\n<p><strong>OWNERSHIP<\/strong><\/p>\n<ul>\n<li><strong>The ownership of the lot or lots shall not pass to the buyer until the buyer has paid the full amount due to the auctioneer.<\/strong><\/li>\n<\/ul>\n<p><strong>DESCRIPTIONS AND CONDITIONS<\/strong><\/p>\n<ul>\n<li><strong>\u00a0We seek to describe lots accurately.\u00a0 Prospective buyers are given ample opportunity to view, enquire\u00a0and inspect before any sale and they must satisify themselves as to the accuracy of any description applied to a lot.<\/strong><\/li>\n<\/ul>\n<p><strong>FORGERIES AND REFUNDS<\/strong><\/p>\n<ul>\n<li><strong>Any lot which proves to be a deliberate forgery may be returned to us within twenty one days of the date of sale of the\u00a0online auction provided it is in the same condition as when bought and accompanied with\u00a0 particulars identifying it from the relevant catalogue description with a written statement of defects and if we are satisified from the evidence presented that this lot is a deliberate forgery, we shall refund the money paid by you for the lot including any buyers premium provided the catalogue description reflected the accepted view of experts at the date of the sale.<\/strong><\/li>\n<\/ul>\n<p><strong>COLLECTION OF GOODS<\/strong><\/p>\n<ul>\n<li><strong>Goods must be collected within one week of purchase unless prior arrangements are made with the auctioneer.<\/strong><\/li>\n<\/ul>\n<p><strong>DAMAGE<\/strong><\/p>\n<ul>\n<li><strong>Any damage caused to any\u00a0 lot at the viewing or after an auction such damage shall be made good by the person committing the damage and the amount will be assessed by the auctioneers who shall have absolute discretion.<\/strong><\/li>\n<\/ul>\n<p><strong>COMMISSION BIDS<\/strong><\/p>\n<ul>\n<li><strong>Where there are two or more commission bids at the same level, we reserve the right to use our absolute discretion to prefer the first bid
